Terms of Service

1. Acceptance of terms

By accessing or using Talobook, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. These terms apply to all users, including visitors, buyers, and creators.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use Talobook. By using the service, you represent and warrant that you meet this requirement. We reserve the right to terminate accounts that do not meet eligibility requirements.

3. Description of service

Talobook is a self-publishing platform that enables creators to distribute and sell their own digital collections — including images, video, and audio — directly to their audience. We do not curate, host, or distribute third-party content on behalf of creators. Instead, each creator maintains their own profile and is solely responsible for the content they publish. We facilitate transactions between individual creators and buyers, and provide payment processing where applicable. We act as a platform provider and payment facilitator, and are not party to the agreement between creators and buyers regarding the content itself. Each creator is an independent publisher responsible for their own content.

4. User accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information when registering, and keep your account details up to date. You must notify us immediately of any unauthorised use of your account. We are not liable for any losses caused by unauthorised use of your account.

5. Creator content and conduct

Creators retain full ownership of the content they publish on Talobook. By publishing content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, and deliver that content solely for the purpose of operating the platform. You represent and warrant that:

  • You have all necessary rights to publish and sell your content, including ownership or valid licensing of all intellectual property included
  • Your content does not infringe the intellectual property, privacy, or other rights of any third party
  • Your content complies with all applicable laws and regulations
  • You are solely responsible for ensuring your content meets these requirements

You must not upload content that: infringes the intellectual property or privacy rights of others; is unlawful, defamatory, or obscene; constitutes spam or misleading material; includes adult content; facilitates illegal activity; or otherwise violates our community standards or applicable law. Talobook is not responsible for creator content and does not endorse, guarantee, or assume liability for any content published by creators.

6. Creator compliance and payment processing

Talobook uses Stripe to process payments. All creators and buyers must comply with Stripe's Services Agreement and Stripe's Prohibited and Restricted Businesses list. Creators warrant that:

  • Their use of Talobook does not involve any prohibited activity, including money transmission, peer-to-peer payments, or sales of prohibited goods or services
  • They will not use Talobook to facilitate transactions that violate Stripe's policies
  • They understand that their sales must represent legitimate sales of their own digital content only

Talobook monitors the platform for compliance with these standards. We reserve the right to suspend, terminate, or withhold payouts if we reasonably believe a creator or buyer is violating Stripe's policies, these terms, or applicable law. Stripe may also require additional information or take action directly on accounts for compliance reasons.

7. Purchases and refunds

All purchases of digital collections are generally final upon completion, given the nature of digital goods. Where required by applicable consumer law, you may be entitled to a refund — for example, if the content is materially different from what was described, or if a technical fault prevents access. To request a refund, please contact our support team within 14 days of purchase. We reserve the right to decline refund requests that do not meet these criteria.

8. Fees and payouts

Talobook may charge platform fees or take a percentage of creator sales. Fee details are outlined in your creator dashboard. Payouts to creators are subject to our payout schedule and any applicable minimum thresholds. We reserve the right to withhold, suspend, or reverse payouts in cases of suspected fraud, chargebacks, violations of these terms, or if Stripe requires it for compliance reasons.

9. Prohibited conduct

You agree not to: use Talobook for any unlawful purpose; attempt to gain unauthorised access to our systems or other users' accounts; reverse engineer, scrape, or copy any part of the platform; engage in any conduct that disrupts or interferes with the service; impersonate any person or entity; or use Talobook in violation of Stripe's Prohibited and Restricted Businesses list.

10. Suspension and termination

We reserve the right to suspend or terminate your account at our discretion if you violate these terms, engage in fraudulent activity, violate Stripe's policies, or if we are required to do so by law or by Stripe. You may close your account at any time through your account settings. Termination does not affect any outstanding obligations, such as payments owed.

11. Disclaimer of warranties

Talobook is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free from harmful components. To the extent permitted by law, we disclaim all implied warranties, including those of merchantability and fitness for a particular purpose. We are not responsible for the quality, accuracy, legality, or completeness of any content published by creators.

12. Limitation of liability

To the fullest extent permitted by applicable law, Talobook shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including loss of profits, data, or goodwill. Our total liability to you for any claim arising under these terms shall not exceed the greater of £50 or the total amount you paid to us in the 12 months preceding the claim.

13. Governing law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of Talobook shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by consumer protection law in your jurisdiction.

14. Changes to terms

We may update these terms from time to time. For material changes, we will notify registered users by email or via an in-app notice at least 14 days before the changes take effect. The updated terms will be posted on this page with a revised "Last updated" date. Continued use of Talobook after changes take effect constitutes acceptance of the revised terms.
